\n<\/strong>
\nAs stated in chapter 1.7 Civil Society, the pressure on civil society organizations has rapidly
\nintensified in Republika Srpska. It should be noted that it is a continuation of attacks on
\ncivil society organizations in Republika Srpska. Let us recall that the ruling political party in
\nRepublika Srpska (SNSD) has published a book containing a list of associations undermining the\u00a0constitutional order of Republika Srpska on their official website in February 2014; the list has\u00a0been recognized by the public as \u201cthe black list of non-governmental organizations\u201d. Disclosure\u00a0of such content by the ruling party is threatens the safety of human rights defenders, who work\u00a0in these associations, which can potentially result in attacks on them.<\/p>\n

Civil society organizations warn that the mechanism of rigorous control of their financial and\u00a0tax activity has never been questioned and that the alleged motive of the ruling structures of\u00a0\u201cestablishing order in the civil sector\u201d is only an excuse for introducing repressive measures. All\u00a0associations and foundations are obligated to act according to the national legislation, including\u00a0the mandatory annual financial reports to the authorities, and to be fully accessible to the auditing.<\/p>\n

The Right to Freedom of Assembly<\/em> is still compromised. To date there has been no criminal\u00a0prosecution of the last year\u2019s attack on the LGBT Festival Merlinka (on February 1st, 2014), when\u00a0the police of the Sarajevo Canton, although the assembly was duly announced, has failed to\u00a0ensure the festival.<\/p>\n

The registration of organizations and foundations<\/em> is still made difficult by the procedures of the\u00a0relevant institutions. The process of registration takes up to a year, which is illegal. BiH Ministry\u00a0of Justice, one of the ministries authorized for the registration of associations, presumes the role\u00a0of intervening in the text of the objectives of the association, restricts the choice of name of the\u00a0future association or foundation, for which there are no reasonable or objective reasons.<\/p>\n

Legal framework<\/strong><\/p>\n

Different levels of government (state, entity, cantonal) have their own laws on
\nassociations and\/or foundations. In Bosnia and Herzegovina there is no single register of
\nassociations and foundations.<\/p>\n

Recommendations<\/strong>
\n\u2022 Systematically regulate the issue\u00a0of the registration and operation\u00a0of associations and foundations\u00a0at all levels of government, with\u00a0consultations with the civil society\u00a0organizations;
\n\u2022 Guarantee the right of assembly to\u00a0minority groups as well.<\/p>\n
